ACTION CENTER: Two Unanimous Judicial Confirmation Votes To Fill Judicial Emergency Vacancies - More Are Needed

The Senate Monday night unanimously confirmed two long-pending nominations -- Amy Totenberg and Steve Jones -- to fill judicial emergencies in the Northern District of Georgia. However, the crisis for the federal courts extends well beyong any one state. Senate Majority Leader Reid and all Senators need to do all they can to bring the President's nominees to the floor for votes. Of the 99 current vacancies on the federal bench, 44 have been officially declared judicial emergencies.

The current wave of political attacks on Planned Parenthood, the nation’s largest provider of reproductive health care for women, is the latest example of a now-familiar kind of coordinated propaganda campaign waged by right-wing activist groups, far-right pundits and media outlets, and politicians willing to collaborate in promoting false information for political purposes. This dishonest hit job on Planned Parenthood is being promoted by many of the same groups and individuals responsible for marketing the deceptive and manipulated videos that were used to mount the now-discredited attacks on ACORN and on Shirley Sherrod, formerly of the U.S. Department of Agriculture.

Citizenship in the Balance: New Report Examines Right-Wing Efforts to Repeal Constitutional Citizenship

Efforts to deny the right of citizenship to some children born in the United States not only stand on shaky constitutional and historical ground, but threaten to drown out productive debate on immigration reform with misleading anti-immigrant rhetoric, argues a new report from People For the American Way.

The report, Citizenship in the Balance, examines efforts by state and federal legislators to deny citizenship to the U.S.-born children of undocumented immigrants, the historical context of such arguments, and the practical consequences of any change to the Constitution’s definition of citizenship. It also provides a guide to some of the leading organizations and activists in the movement to gut the 14th Amendment.

This years annual Conservative Political Action Conference highlighted some of the fracture lines within the right-wing movement when several prominent Religious Right groups decided not to attend over the inclusion of GOProud, an LGBT conservative organization. The conference, however, ended up being, as it is every year, a "who's who" of the Religious Right, Tea Party and broader conservative movement.

Tell Clarence Thomas to Recuse Himself in Future Health Care Reform Cases

 

Justice Thomas' wife Ginni has earned hundreds of thousands of dollars working for and leading groups that have repealing health care reform as one of their chief goals. Considering challenges to the health care law are expected to reach the Supreme Court, that could present a major conflict of interest. Rep. Anthony Weiner of New York and 73 of his colleagues are calling on Justice Thomas to recuse himself from hearing future cases on the health care reform law.

In addition to his wife Ginni's history with groups focused on repealing health care reform, Justice Thomas' own failure to list his wife's income on judicial disclosure forms and his involvement with a strategy retreat held by the Koch brothers have raised serious questions. Justice Thomas is now starting to fire back against his critics in speaking engagements.

PFAW Commends President Obama's Stand Against Unconstitutional Defense of Marriage Act

Attorney General Eric Holder has announced that the Department of Justice will no longer defend Section 3 of the Defense of Marriage Act in court because it is unconstitutional. This is the provision prohibiting federal recognition of the marriages of gay or lesbian couples. As if that wasn't big enough news by itself, DoJ has concluded that legal classifications based on sexual orientation, like those based on race, sex, national origin, and religion, should be subject to a higher level of judicial scrutiny.

Amid Demands For His Resignation From PFAW, Indiana Official Who Encouraged Violence Against Wisconsin Protestors Resigns

 

A deputy attorney general in Indiana suggested on Twitter to "use live ammunition" against protesters in Madison, Wisconsin. In a back-and-forth with a writer for Mother Jones magazine, he followed up, "You're damned right I advocate deadly force."

When news broke of this incident, PFAW, as well as our members and activists, were among those issuing a call for Cox's immediate resignation -- which came later that same day.

Scott Walker's Revealing Chat with 'David Koch'

 

When a reporter from the Buffalo Beast called Wisconsin Governor Scott Walker and pretended to be billionaire industrialist and GOP bankroller David Koch, he spoke to the inaccessible governor for 20 minutes about his plans to wipe out public employee's collective bargaining rights. A spokesman for the governor dismissed the importance of the conversation, "The governor takes many calls everyday," but clearly the tapes reveal that Walker and 'Koch' were plotting strategy to "crush" labor unions and compel Democratic State Senators to return to the capital. Walker said he is willing to "talk, not negotiate" with Wisconsin Democrats, "they'll have to back down." Walker told 'Koch' "I have a slugger with my name on it" and "I've got layoff notices ready" for public employees.

Women in Congress Speak Out on Attacks on Women's Health

 

As the House debated an amendment from Rep. Mike Pence that would strip Planned Parenthood of federal funding, some women in Congress responded with personal stories.

Rep. Jackie Speier of California revealed that she had had an abortion for a troubled preganancy, telling her anti-choice colleagues: "I lost the baby. And for you to stand on this floor and suggest that somehow this is a procedure that is either welcomed or done cavalierly or done without any thought, is preposterous."

Los Angeles County sheriff Lee Baca -- who heads the nation's seventh largest law enforcement agency, overseeing the safety of ten million people -- is calling Rep. Peter King's bluff on the congressman's claim that the American Muslim community "does not cooperate" with law enforcement.

Obama Rescinds Dangerous Bush-Era "Conscience Regulation"

 

The Obama Administration rescinded most of a Bush-era "conscience clause" regulation that gave special legal rights to health workers who refuse to provide care they find objectionable on personal or religious grounds. Under the Bush rule, hospitals, health plans, and clinics would lose federal funding unless they allowed doctors and other employees to refuse to provide medical care that violated their personal, moral, or religious beliefs.

Fox News' graphics department consistently and persistently makes "mistakes" that show incorrect poll numbers, mislabel people's party affiliation, and do other things to cast Fox’s favored side of a debate in a positive light and to smear its opposition.

Barber Says Islam Is Satanic While Tennessee Seeks To Make It A Felony

 

In his latest column, Matt Barber of Liberty Counsel claims that the "useful idiots on the American left represent every bit the threat to both this great republic and her unalienable freedoms as do the Muslim extremists with whom they play footsy."

Today, Barber was invited on The Matt Friedeman Show on the AFA's radio station to further elaborate during which he blasted churches that allow Muslims to use their facilities so long as the Muslims "just please try not to behead us on your way out the door" and attacked Islam as, literally, Satanic.

Given that this attitude toward Islam seems foundational among Christian conservatives, I guess it should not really come as a surprise that legislators in Tennessee have introduced a bill that makes it a felony for anyone to follow Shariah and which carries a fifteen year sentence.
